Discharge Leads To Jail Time

(SCOTTSBLUFF, Neb.) — On February 6, 2025, at approximately 8:10 a.m., Scottsbluff Police Officer Stefan Yocum investigated an incident that occurred around 12:00 a.m.

A citizen provided security camera footage showing Quentin Alexander Biery and a female arguing in the street. The footage captured Biery pulling out a firearm and discharging it into the air five to six times while walking northbound on 2nd Avenue. The citizen found five brass .45 caliber handgun casings in the street, which Officer Yocum collected as evidence.

The female confirmed she was with Biery but denied an argument. She stated she heard gunshots after walking away but did not witness Biery fire the weapon. She also denied knowing Biery had the firearm but acknowledged he was the one who discharged it. The female described Biery’s attire and his residence near 5th Avenue.

Court records showed Biery had a prior felony conviction in Scotts Bluff County District Court Case CR 23-655. An arrest warrant was issued for Quentin Biery.

Charges:

Count 1: Felon, Fugitive/Prohibited Person in Possession of a Firearm, Class ID Felony

Plea Agreement and Sentence

In the District Court of Scotts Bluff County, Nebraska, for Case No. CR25-74, the State of Nebraska represented by Dave Eubanks.

The defendant will enter a plea of guilty or no contest to an Amended Information, which charges:

Count 1: Felon, Fugitive/Prohibited Person in Possession of a Firearm, Class 1D Felony

The State will recommend the mandatory minimum of 3 years at sentencing.


On October 20, the defendant appeared via zoom before Judge Miller, who took into consideration his age, mentality, cultural background and a pre-sentencing report to sentence him to 8 Years with 239 days credit.
