Probation Revoked

(SCOTTSBLUFF, Neb.) — On the evening of June 5, 2023, Scottsbluff Police Officer Genoways responded to 1423 2nd Ave. in reference to a possible warrant. The homeowner gave them permission to search the home, where they found Benjamin De Los Santos and escorted him outside of the home. When asked if he had anything on his person he stated “not that I know of”, then attempted to reach in his pockets. Officers then asked if he had anything illegal on him and he admitted to having meth in his left pocket. Officer Genoways found a silver twist top vial containing a white crystal substance suspected to be meth.

After he was handcuffed, they were given consent to search the home for drugs. In a back bedroom, a black backpack contained a large plastic self seal bag with 25 grams of white crystal substance, along with several small baggies, four empty syringes, a meth bong containing residue and a large torch. After reading him his rights, De Los Santos admitted that the bag and other items were his.

De Los Santos was found guilty of distribution of Methamphetamine and was placed on probation starting November 14, 2023. Now according to Probation, he has violated numerous rules established by the courts:

  • No.1 on June 30, 2025 he was arrested for a warrant and found with a plastic container with white crystal substance, a digital scale, zip lock baggies, a syringe and a glass pipe.
  • No.3 in that he failed to report to probation for scheduled appointments
  • No.5 In that he failed to notify probation of his change of address
  • No.9 in that he failed to report to the probation officer for drug testing 4x in May of 2025 with testing positive for meth on May 8 and 23 and June 5, 2025. On May 27th he tested positive for meth, amphetamine and ecstasy.
  • No.10 he failed to complete the program for mental health and substance abuse treatment. He failed to check into treatment at Centre Point on June 9, 2025

On October 14th, De Los Santos appeared before Judge Dobrovolny via zoom for a motion to revoke probation and sentencing following. The judge noted that since he’s done two stints in jail and has failed to comply with probation, he sentenced the defendant to 5-10 years with 117 days served and eligible for parole after 30 months. This sentence would run concurrently with any other jail sentence.

De Los Santos was back in court today, October 15 where he plead guilty to the charges from June 30th. His sentencing is scheduled for December 12th for the charge of possession with intent to distribute a controlled substance (methamphetamine).
