License Revoked for Fourth DUI

(GERING, Neb.) — A Gering man has been sentenced to jail and ordered to surrender his driver’s license for 15 years following a January impaired-driving arrest.

Adam A. Ramirez, 60, was sentenced Sept. 25 in Scotts Bluff County District Court by Judge Leo Dobrovolny.

Under the sentence, Ramirez received 364 days in jail for DUI and 90 days for driving under suspension. The court granted him 250 days of credit for time served.

According to police affidavits, Gering officers responded late Jan. 7 to a report of a verbal disturbance at a home on Q Street. Upon arrival, officers found Ramirez inside a running pickup truck nearby and exhibiting signs of alcohol impairment.

After refusing preliminary testing, Ramirez was taken into custody. Officers later obtained a search warrant for a blood draw. A search of the vehicle also yielded 6.3 grams of marijuana.

Ramirez was originally charged with fifth-offense DUI, a Class IIA felony; driving under suspension, a Class IIA felony; refusing a preliminary test; and possession of marijuana.

Under a plea agreement, Ramirez pleaded no contest to amended charges of DUI with a blood alcohol concentration of at least 0.08, fourth offense, a Class IIIA felony, and driving under suspension, a Class III misdemeanor. The remaining charges were dismissed.

In addition to his jail sentence, Judge Dobrovolny revoked Ramirez’s driver’s license for 15 years. He will be eligible to apply for an ignition interlock device after 45 days.
