(GERING, Neb.) — A Scottsbluff man charged with felony terroristic threats after allegedly brandishing a replica handgun during an argument was bound over to district court Monday after waiving his right to a preliminary hearing.
Kirt O. Royball, 41, appeared in custody before Scotts Bluff County Court Judge Kristen D. Mickey on Oct. 5, 2026.
Royball waived his right to a preliminary hearing under a joint stipulation between defense attorney Cody Adamson and County Attorney Allison Witcofski.
Under the agreement, Judge Mickey reduced Royball’s bond to $7,500, with 10% allowable, and bound the case over to Scotts Bluff County District Court.
The Class 3A felony charge of terroristic threats stems from a Sept. 22, 2026, incident near 810 16th Avenue in Scottsbluff.
According to an affidavit of probable cause filed by Scottsbluff Police Officer Michael Modec, dispatch received a 911 call reporting a disturbance involving a suspect armed with a firearm.
The reporting party told officers that Royball accused him of theft and threatened him with a handgun.
Police located Royball a few blocks away near Lakota Lutheran Church and recovered a replica handgun in the area.
According to court records, officers reviewed video footage of the encounter. The victim told officers he believed the weapon was real and feared for his safety.
Royball is scheduled to be arraigned in Scotts Bluff County District Court at 1 p.m. Oct. 16, 2026.
