Labor Day Stop Sentencing Due

(GERING, Neb.) — A Mitchell man faces upcoming sentencing in Scotts Bluff County Court after changing his plea to guilty on an amended drunk driving charge following a Labor Day stop.

Frank M. Canseco Jr. changed his plea to guilty for DUI (.15+), a Class W misdemeanor, as part of an agreement. In exchange for the plea, prosecutors dropped a secondary Class 3 misdemeanor charge for driving under suspension.

The charges stem from an early morning response on September 7, 2026, around 2:53 a.m., after an employee at Essential Fuels on West 27th Street reported an intoxicated man stumbling around before driving away in a white pickup truck.

Responding officers located the matching vehicle traveling eastbound at very low speeds in the 100 block of West 24th Street and initiated a traffic stop. The driver, identified as Canseco, exited the vehicle with his hands up. Officers noted dilated pupils, bloodshot eyes, slurred speech, and a strong odor of alcohol, with Canseco leaning against his truck seat for support.

After admitting to drinking alcohol and showing signs of impairment during field sobriety tests, Canseco submitted to a preliminary breath test that recorded a breath alcohol concentration of .310—nearly four times the legal limit.

Court records show Canseco is represented by attorney Cody Adamson.

Sentencing is scheduled for November 24, 2026, at 9:30 a.m. in Scotts Bluff County Courtroom 1.
