(GERING, Neb.) — A 29-year-old Gering woman was sentenced Oct. 14 to seven days in jail after pleading no contest to an amended charge of disturbing the peace following an August disturbance, according to Scotts Bluff County Court documents.
Shayla Otero entered the plea to the amended municipal ordinance charge, an infraction, after original charges of assault or battery were reduced.
According to an affidavit of probable cause, officers with the Gering Police Department responded to a residence on North Street on Aug. 23 around 9:30 p.m. following a report of a physical altercation. The reporting party stated that he had been struck with a metal level following an argument regarding alcohol delivered to the residence.
Responding officers noted fresh blood on the victim’s left middle finger and a slight scratch on the right side of his neck. The victim declined medical assistance.
During the investigation, officers confirmed a standing probation order requiring Otero to be taken into custody if she tested positive for alcohol or refused a preliminary breath test. After initially refusing a breath test at the scene, Otero was transported to Regional West Medical Center for medical clearance, where she provided a breath sample testing at 0.039 BAC. She was subsequently booked into the Scotts Bluff County Detention Center on charges of simple assault and a probation violation.
During the court appearance, Scotts Bluff County Court Judge Kristen D. Mickey sentenced Otero to seven days in jail and credited 46 days of time served toward her $500 fine and $49 in court costs. The additional seven days brought the total time-served credit to 53 days.
