(GERING, Neb.) — A 25-year-old Scottsbluff man was sentenced to 12 months of probation and ordered to pay $1,300 in fines after pleading no contest to impaired driving and traffic charges Tuesday in Scotts Bluff County Court.
Alkaid L. Palacio, 25, of Scottsbluff, entered no contest pleas to first-offense driving under the influence, driving under suspension and refusing to submit to a chemical test.
County Court Judge Kovarik sentenced Palacio to one day in jail, with credit for time served, suspended his driver’s license and required him to install an ignition interlock device before his driving privileges can be reinstated.
The charges stem from a May 16 traffic stop on Highway 92 near mile marker 30. According to a probable cause affidavit, Trooper Swantek stopped a westbound BMW for traveling 72 mph in a 65 mph zone.
During the stop, Swantek noted that Palacio had bloodshot eyes, slurred speech and an odor of alcohol. Palacio admitted to coming from a local bar but said his driver’s license was suspended. He refused to perform standardized field sobriety tests or submit to a breath test.
After law enforcement obtained a search warrant signed by District Court Judge Dobrovolny for a blood draw at Regional West Medical Center, Palacio again refused to submit to the test or sign the advisement form.
As part of the plea agreement, additional charges, including speeding, refusal to submit to a preliminary breath test and obstructing government operations, were dismissed.
