Will Video Evidence Grant Ojeda Bail?

(SCOTTSBLUFF, Neb.) —  According to court affidavits obtained by Panhandle Scanner, on Wednesday, July 2, 2025, the victim in this case contacted law enforcement.  She reported that while walking from her car to the East entrance of an apartment building located 1413 E 17th St, the suspect named as Joseph Ojeda, placed his arms around her and grabbed her butt and her intimate area under her shirt and bra. Then when she pushed him away and continued towards the East entrance, she says he persisted to the point where he “jerked” her sideways causing pain.

When police questioned Ojeda about what occurred in the parking lot he stated he grabbed her butt, but not sexually. That’s when the officer placed Ojeda under arrest and was transported to Scotts Bluff County Detention Center.

On July 15, 2025, Ojeda appeared in court for a probable cause hearing dressed in Scotts Bluffs County orange. The defense argued that the original charge of Assault on a Health Care Worker wouldn’t be applicable because the language of the statue requires the offense to be on hospital or clinic property. In the end, both the prosecutor and the Ojeda defense team agreed that the Probable Cause exists for assault charges, but it did not meet the original statue.

Then, in another twist of events, during bond review on August 22, the Ojeda defense appeared ready to fight the charges even further.  The defense entered as Exhibit 2, a video which is believed to be enough evidence to grant a reduced bond or even release Ojeda on his own recognizance.

The Honorable Judge Worden agreed to watch the newly obtained video, but under the condition that the prosecutor has an opportunity to also enter new video evidence as long as it is not footage found in exhibit 2.

The concern is that a video shows a moment in the situation, often time video may exist either before or after the time of the allegations to help further help understand the situation.

Now we wait for the judge to decide if the last minute video will be enough for a reduced bond or perhaps enough for Ojeda to be released.
